These Terms of Service (“Terms”) govern your access to and use of the CryptoCloaks website located at
https://www.cryptocloaks.com (the “Website”), including all content, functionality, products, and services offered through the Website (collectively, the “Services”).

By accessing the Website, creating an account, or purchasing products from CryptoCloaks, you (“User,” “You,” or “Your”) agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. Updated versions will be posted on the Website with a revised Effective Date. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

1. Eligibility

2. Account Registration

CryptoCloaks reserves the right to suspend or terminate accounts suspected of fraud, abuse, or violation of these Terms.

3. Orders, Pricing, and Payments

All orders are subject to acceptance by CryptoCloaks.

We reserve the right to:

  • Refuse or cancel any order

  • Limit purchase quantities

  • Cancel orders suspected of fraud or abuse

  • Correct pricing or listing errors

Prices are listed in USD unless otherwise stated. Payment must be completed at checkout.

Fiat payments are processed by third-party processors such as Stripe and are subject to their respective terms and conditions. CryptoCloaks is not responsible for errors, fees, or actions taken by payment processors.

Cryptocurrency Payments

Cryptocurrency transactions are final and irreversible once confirmed on the blockchain. Crypto payments do not support chargebacks.

Approved refunds may be issued:

  • In the original cryptocurrency, or

  • In the USD equivalent value at the time of refund issuance (based on a reputable market index determined by CryptoCloaks)

Refund methods (including currency and timing) are determined solely at the discretion of CryptoCloaks.

Customers must provide a valid wallet address for cryptocurrency refunds. CryptoCloaks is not responsible for:

  • Incorrect wallet addresses provided by customers

  • Cryptocurrency value fluctuations

Chargeback Policy

For fiat payments, customers are encouraged to contact:

before initiating a chargeback or payment dispute.

Fraudulent, abusive, or bad-faith chargebacks may result in:

  • Account termination

  • Recovery of associated fees, damages, and costs through appropriate channels

4. Shipping and Delivery

Shipping times provided on the Website are estimates only.

Delays may occur due to:

  • Shipping carriers

  • Customs processing

  • Weather events

  • Supply chain disruptions

  • Other factors beyond our control

Title and risk of loss transfer to the customer when the shipment is delivered to the carrier, except where prohibited by applicable law.

Customers are responsible for:

  • Providing a secure delivery location

  • Any import duties, customs fees, or taxes imposed by their jurisdiction

CryptoCloaks is not responsible for packages lost or stolen after confirmed delivery.

5. Intellectual Property

All content on the Website including:

  • Graphics

  • Product designs

  • Logos

  • Trademarks

  • Images

  • Software

is the property of CryptoCloaks or its licensors and is protected by intellectual property laws.

Users receive a limited, non-exclusive, non-transferable license to access and use the Website for personal, non-commercial purposes.

Users may not:

  • Reproduce or distribute materials

  • Reverse engineer products or software

  • Use trademarks or branding without written permission

6. User Generated Content

If users submit reviews, feedback, or other content, they grant CryptoCloaks a:

perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display such content for marketing or operational purposes.

Users represent that submitted content does not violate laws or third-party rights.

CRYPTOCURRENCY MINERS, ELECTRONICS, AND RELATED HARDWARE SOLD BY CRYPTOCLOAKS GENERATE SIGNIFICANT HEAT AND ELECTRICAL LOAD.

THESE PRODUCTS MAY POSE RISKS INCLUDING:

  • Fire

  • Electrical shock

  • Property damage

  • Personal injury

  • Death

BY PURCHASING OR USING THESE PRODUCTS, YOU ACKNOWLEDGE AND ACCEPT THESE RISKS TO THE EXTENT PERMITTED BY APPLICABLE LAW.

Users are responsible for ensuring:

  • Proper installation

  • Adequate electrical capacity

  • Proper ventilation

  • Compliance with all local laws and safety standards

Professional installation by a licensed electrician is strongly recommended.

9B. Cryptocurrency and Digital Asset Risk Disclaimer

Cryptocurrency involves risks including:

  • Volatility

  • Software bugs

  • Wallet failures

  • Loss of private keys

CryptoCloaks does not control:

  • Blockchain networks

  • Mining pools

  • Exchanges

  • Wallet providers

CryptoCloaks is not responsible for loss of cryptocurrency or digital assets.

9C. Product Modification Disclaimer

Any firmware flashing, hardware modification, or third-party alterations performed by the user:

  • Voids return eligibility

  • Releases CryptoCloaks from liability for any related issues, damages, or claims

10. Warranty Disclaimer

ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW.

CryptoCloaks DISCLAIMS ALL WARRANTIES, INCLUDING:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Safety

  • Error-free operation

to the extent permitted by applicable law (including the Magnuson-Moss Warranty Act where applicable).

CryptoCloaks does not guarantee:

  • Mining profitability

  • Hardware uptime

  • Compatibility with third-party software or networks

11. Limitation of Liability

To the maximum extent permitted by law, CryptoCloaks shall not be liable for:

  • Indirect damages

  • Incidental damages

  • Consequential damages

  • Special damages

  • Punitive damages

including loss of profits, funds, data, property damage, or personal injury.

Total liability shall not exceed the amount paid for the specific product giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless CryptoCloaks and its officers, employees, and affiliates from claims, damages, losses, and legal expenses arising from:

  • Misuse of products

  • Violation of these Terms

  • Violation of applicable laws

13. Refund and Return Policy

Items may be eligible for return within 30 days of delivery if they are:

  • Unused

  • In original packaging

  • In the same condition received

Returns require a Return Merchandise Authorization (RMA).

Unauthorized returns may be refused.

Restocking Fees and Processing Costs

  • A $10 restocking fee applies to working or unopened miners

  • Fiat payment processing fees (including Stripe fees) are non-refundable

  • Customers are responsible for return shipping costs

Refund Processing

Refunds are issued after returned items are inspected.

Processing may take up to 14 days after inspection.

Refunds will be issued:

  • Using the original payment method where possible, or

  • At CryptoCloaks’ discretion, the equivalent value in the original cryptocurrency or USD (based on market value at issuance)

14. Dispute Resolution and Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association.

Arbitration shall occur in:

Denver, Colorado

This arbitration agreement is governed by the Federal Arbitration Act.

Users waive the right to participate in class action lawsuits.

Small claims court claims are permitted where applicable.

15. Limitation on Time to File Claims

Any claim arising from use of the Services must be filed within two (2) years after the cause of action arises, to the extent permitted by applicable law.

16. Export Compliance

Products may not be exported or re-exported in violation of U.S. export laws or to sanctioned jurisdictions.

17. Force Majeure

CryptoCloaks is not liable for failure or delay in performance caused by events beyond reasonable control, including:

  • Natural disasters

  • Internet outages

  • Labor disputes

  • Supply chain disruptions

  • Government actions

18. Termination

CryptoCloaks may suspend or terminate access to the Website or Services at any time for violations of these Terms.

19. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

20. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

21. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and CryptoCloaks regarding the Services.

23. Product Resale and Commercial Redistribution

Products purchased from CryptoCloaks are intended for personal use unless otherwise authorized.

Unauthorized resale or redistribution is prohibited.

Resellers assume all liability and agree to indemnify CryptoCloaks against claims arising from resale or redistribution.
